Poland’s Supreme Administrative Court ordered the registration of a foreign same-sex marriage certificate. The case makes a strong precedent for the rest of the region, but the implementation is far from complete.
Earlier this March the court ordered the head of the Warsaw Civil Registry Office to enter the same-sex marriage certificate and transfer all relevant documentation, effectively breaking with years of administrative practice that treated such a transcription as impossible. The men had been living in Berlin, where they married in 2018. After returning to Poland, they sought recognition of their marriage there, triggering a legal battle lasting several years.
The ruling has been closely followed by administrative courts across Poland. Until now, they operated in an atmosphere of uncertainty over how to handle such requests.
On 28 April 2026 another decision came into the spotlight. The Lublin Voivodeship Administrative Court ordered the head of the Civil Registry Office to enter another couple’s marriage certificate into the civil status register by way of transcription within 30 days. This is the fourth such court ruling in recent weeks.
